Most of my clients file either Chapter 7 or Chapter 13 bankruptcy. Chapter 7 bankruptcy is best for credit card and medical debt. Chapter 13 bankruptcy can be used to save the house from foreclosure or handle possible outstanding income tax debt. Certain debt cannot be discharged in bankruptcy. Some common types are student loans, family support obligation and certain tax debt.
A common misconception of bankruptcy is that you'll lose your house or your car. Typically that is not true. Bankruptcy can be a good option for people because it will stop the creditor harassment, lawsuits and will give you a fresh start. The filing of bankruptcy does not have to be a lengthy process. At my office it's a matter of weeks, not months before your case is filed.
